Image release
Information notice and conditions for the recording, use and distribution of the images captured through the HiPadel system, pursuant to Article 10 of the Italian Civil Code, Articles 96 and 97 of Italian Law 633/1941 and Regulation (EU) 2016/679.
Informal translation. This English version is provided for information only. In the event of any discrepancy, the Italian version prevails and is the sole legally binding text. Read the Italian version.
01What is filmed
The HiPadel system records the matches played on the courts of the clubs that have activated the service. Footage may be captured by the cameras installed courtside and connected to the HiBox, or by a club smartphone or tablet using the Virtual Box function.
The footage frames the playing area. In addition to the players, people present courtside or in the adjacent areas may also appear in the frame.
- Full match — the complete recording of the match, available in the player's personal archive.
- Highlights clips — clips of a few seconds saved at the player's explicit request through the GiveMe5 sensor.
- Live streaming — the real-time broadcast of the match on the channels chosen by the club.
02Legal basis and consent
The recording and subsequent publication of the image of an identifiable person require their freely given, specific, informed and unambiguous consent, pursuant to Article 6.1.a and Article 7 GDPR, as well as Article 96 of the Italian Copyright Law.
Consent is collected by the club before the service is used, in writing or through digital acceptance in the HiPadel app. It is separate for each purpose: the data subject may consent to recording for personal use only and refuse consent to public distribution.
03Purposes of use
The images collected may be used exclusively for the purposes for which consent was given:
- making the recording and the clips available in the player's personal archive within the app;
- sharing by the player themselves on their own channels or in their own chats;
- live streaming of the match on the club's channels and on the internal monitors of the facility;
- promotion of the club and its activities, if expressly authorised;
- security of the facilities, limited to video surveillance footage and under the terms laid down by the applicable legislation.
The images are not transferred to third parties for commercial purposes, are not used to train biometric recognition systems and are not subject to profiling.
04Minors
For persons under eighteen years of age, consent is given by both parents or by the holder of parental responsibility. The club must collect and retain the signed image release before activating footage of matches involving minors.
In the absence of such consent, footage cannot be activated, nor may the minor's image be distributed in any form, not even within the facility.
05Duration, withdrawal of consent and erasure
Consent remains valid until withdrawn. Withdrawal of consent is free of charge, requires no reason and may be exercised at any time by writing to privacy@hipadel.tv or by contacting the club directly.
Following withdrawal of consent, the images portraying the data subject are removed from the archives and the channels managed by the club within thirty days. Withdrawal does not affect the lawfulness of the use that took place before the withdrawal itself, nor does it have any effect on content already downloaded or re-shared independently by third parties on platforms not managed by the club.
06Club obligations
The club that activates the service is an independent Data Controller for the processing of the images recorded on its own courts and undertakes to:
- inform players, companions and guests in advance of the presence of a recording system, by means of visible signage at the entrance and courtside;
- collect and retain the image releases, with particular rigour in the case of minors;
- limit access to the recordings to authorised personnel;
- not distribute images for purposes other than those permitted;
- act without delay on requests for erasure and withdrawal of consent.
07Rights of the data subject
Anyone filmed may at any time request access to the images concerning them, obtain a copy of them, request their rectification or erasure, object to the processing and withdraw consent, in the manner set out in the Privacy Policy. The right to lodge a complaint with the Garante per la protezione dei dati personali (Italian Data Protection Authority) remains unaffected.
